Owing to the nature of human rights everyone is entitled to equal and inalienable human rights as human being. Human rights are centred, indeed built, on the granting of rights to the individual. Main human rights, their implementation mechanism and the obligations of state parties in this regard are enshrined in different international human rights instruments. The main duties of states are to respect, to fulfill and to protect human rights. In compliance with the principle of pacta sunt servanda states parties to these documents undertake to ensure and secure human rights of all within its jurisdiction without discrimination on the basis of sex, race, color, language, religion, political or other opinion, national or social origin, property, birth or other status. States are required to strictly follow their obligations and they are held responsible for violation of human rights even where they were unintentional.

The most commonly used way for cargo transportation is by sea. The main reason for this is the fact that vessels with marine vehicles are able to ship a large amount of cargo and transport costs are fewer than those of other vehicles. The manner of implementation of this process depends on the parties’ consent. Adjustment of freight issue has great importance in any legislative act related to carriage of goods by sea. I think that this issue must be kept in the center of attention from the point of resolving of possible disputes.

This Article is dedicated to determine the limits of carrier’s liability for delay of the cargo in delivery while carrying it from one destination to another. The Article deals with the circumstances that the carrier can refer in order to limit his liability and the circumstances that cause the loss of right to limit liability. The limitation of carrier’s liability for delay in delivery is analyzed on the basis of proper national and international documents including, Merchant Shipping Code of the Republic of Azerbaijan, Hague and Hague-Visby Rules, Hamburg and Rotterdam Rules and other international legal acts.

United Nations published a report[1] last year suggesting that a drone used in Libya’s civil war selected a target without human control. This signifies a new chapter in human history: A machine that identifies and selects target based on Artificial Intelligence; A machine that makes a decision about human life. The report calls them ‘lethal autonomous weapons systems’, but they are also called ‘killer robots’ or ‘slaughterbots’. These systems raise a number of legal and ethical concerns. Killer robots change the relationship between people and technology by giving life and death decision-making to machines. What we watch in movies is not science fiction anymore. We see the cloud, so we should foresee the storm coming.

Social media is an integral part of our daily life. The global digitalization policy, as well as the coronavirus pandemic, have particularly accelerated the process of social media penetration into our personal space. With the ever-increasing role of social media in our lives, privacy is becoming a tool for both social media representatives and third parties who are able to acquire information from various social media platforms. Privacy is new within social media and needs more detailed study and regulation. This article explores the principle of functional equivalence in the context of e-commerce regulation. It begins by highlighting the significance of ecommerce in the modern digital era and the need for robust legal frameworks to govern electronic transactions. The international community's efforts to establish mechanisms for regulating the legal aspects of e-commerce are examined, with a focus on the concept of functional equivalence. The United Nations and the European Union have played key roles in shaping this principle through the adoption of model laws, conventions, and directives. The article then delves into the implementation of functional equivalence in Azerbaijani law, considering the challenges and achievements in aligning national legislation with international best practices. By analyzing the similarities, differences, and limitations in addressing functional equivalence within the framework of the United Nations and the European Union, as well as Azerbaijani legislation, the article emphasizes the importance of continued efforts to bridge gaps and enhance the practical application of this principle. For the purpose of this, the article examines the legal instruments that include the functional equivalence principle and notes the contributions each makes to this approach. Overall, functional equivalence serves as a foundation for creating a secure and equitable environment for ecommerce, promoting trust, confidence, and legal certainty in the digital marketplace.
